Terms of Use

These Terms govern your use of ThaiSparks. By creating an account or otherwise using the service, you agree to them. They are written in plain language so you know what you are agreeing to.
1. Who operates ThaiSparks
ThaiSparks is operated by Demo Labs Pty Ltd (Melbourne, Australia). Where these Terms refer to "we", "us", or "our", that means Demo Labs Pty Ltd.
2. What the service is — and is not
ThaiSparks is an introductions and conversations platform that lets adults discover and chat with other adults. We do not facilitate, arrange, sponsor, or recommend any offline meeting between members. Any decision to communicate off the service, or to meet another member in person, is your own decision and at your own risk.
We do not guarantee that you will meet anyone, form a relationship, or that any particular outcome will follow from using ThaiSparks. Whether the service is useful to you depends entirely on the choices you and other members make.
3. Eligibility
You must be at least 18 years old to create an account on ThaiSparks. We do not knowingly accept signups from anyone younger. If we learn that an account belongs to someone below this age, we remove it immediately. One person, one account — multiple accounts per person, or accounts shared between people, are not permitted.
ThaiSparks is operated for users physically located in Thailand. We do not accept signups from outside Thailand. If you create an account from outside Thailand we may restrict or remove it.
4. No screening, no background checks
You understand that ThaiSparks does not conduct criminal background checks or identity-verification checks on its members, and does not otherwise inquire into the background of its members. ThaiSparks makes no representations or warranties as to the conduct, identity, health, physical condition, intentions, legitimacy, or veracity of any member. We do not interview, screen, or vet members in any way; members manage their own profiles and you interact with them at your own discretion.
We offer an optional selfie-comparison feature that members can choose to complete. If a member has a "selfie-matched" badge, it means only that they completed this optional feature — it does not guarantee identity, age, intent or trustworthiness. We are not in the verification business.
5. Your interactions with other members
You are solely responsible for your interactions with other members. You agree to use caution in all interactions, particularly if you choose to communicate off the service or meet another member in person. Read our Dating Safety guidance before doing either.
You agree to, and hereby do, release Demo Labs Pty Ltd and its affiliates, officers, employees, agents, and successors from any and all claims, demands, losses, damages, rights, and actions of any kind, including personal injury, death, and property damage, that arise either directly or indirectly from your interactions with or conduct of other members, whether online or offline.
6. Your conduct on the service
You agree to:
- Use your real identity. The photos you upload must be of you, and your basic profile details must be accurate.
- Not impersonate another person, public figure, fictional character, or anyone else.
- Not use the service for commercial purposes — no recruitment, sales pitches, advertising, escort or paid-companionship offers, or promotional content directed at other members.
- Not scrape, mirror, or systematically extract data from the service. Automated access of any kind requires our written permission.
- Not harass, threaten, intimidate, defame, or sexually exploit any other member or our staff.
- Not upload illegal content, including but not limited to content depicting minors, non-consensual sexual content, stolen intellectual property, or content that violates the laws of any jurisdiction relevant to either of us.
- Not share another person's private information without their consent.
The full conduct rules are set out in our Community Guidelines, which form part of these Terms (see section 14).
7. Account suspension or termination
We reserve the right to suspend or end your account, immediately and without prior notice, where we believe you have breached one or more of the documents that make up your agreement with us (these Terms, the Community Guidelines, the Refund Policy, the Privacy Policy, or the Cookie Policy). The kinds of breach that result in account action include:
- Uploading or sharing content prohibited by our Community Guidelines — including photos of minors, nudity or sexually explicit content, hate content, weapons, AI-generated impersonation, or commercial advertising.
- Suspected fraud, payment fraud, account takeover, or any use of automated tools (bots, scrapers) against the service.
- Threatening, harassing, predatory, or abusive behaviour toward other members or our staff.
- A pattern of reports or blocks from other members indicating spammy, harassing, predatory, or unsafe conduct.
- Non-payment of an active Premium subscription.
- Operating multiple accounts, sharing an account with another person, or evading a restriction we have previously applied.
- A lawful request from a court, regulator, or law-enforcement authority that requires us to act on your account.
We do not end accounts for reasons outside the grounds described in these documents. If we end your account, any active subscription does not transfer or refund.
You may end your own account at any time through Settings → Delete Account.
8. Subscriptions and payment
ThaiSparks is free to use. Premium is an optional recurring subscription billed through our payment processor. Your subscription renews automatically at the end of each billing period until you cancel. You can cancel any time from Settings → Billing; cancellation takes effect at the end of your current paid period and no further charges are made. We do not offer free trials.
Full refund and cancellation terms are set out in our Refund Policy, which forms part of these Terms (see section 14).
9. Your content
You retain ownership of the content you upload (photos, messages, profile text). By uploading content to ThaiSparks, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, display, reproduce, and adapt that content as necessary to operate the service — including showing your profile to other members, generating resized photo variants, and reviewing content for moderation.
We may remove content that violates these Terms or our Community Guidelines. Removal decisions affecting an account are reviewed by a human moderator before they take effect.
10. Our content
We own the ThaiSparks website, apps, brand, design, code, and other materials we provide. You may not copy, modify, publish, transmit, distribute, sell, or otherwise exploit them without our written permission.
11. No warranty
The service is provided "as is" and "as available", without any warranty of any kind, express or implied, except for those that cannot be excluded under the Australian Consumer Law (see section 13). We do not warrant that the service will be uninterrupted, error-free, secure against all attacks, or that any defect will be corrected.
12. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to ThaiSparks is limited to the greater of (a) AUD $100 or (b) the total amount you have paid to us for the service in the twelve months immediately preceding the event giving rise to the claim.
We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, business interruption, or personal injury arising from interactions with other members.
13. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law that cannot be excluded, restricted, or modified. Those rights include guarantees that services are provided with due care and skill, and are reasonably fit for the purpose described. If you believe you have a claim under those guarantees, contact [email protected] and we will assess it on its merits.
14. Additional documents that form part of this agreement
By accepting these Terms, you also agree to comply with the following documents, which are incorporated by reference and form part of your agreement with us:
- Cookie Policy — what cookies we use and your choices.
- Community Guidelines — the conduct rules; violations may restrict or remove your account.
- Refund Policy — how subscription charges and cancellations work.
- Dating Safety Guidelines — safety expectations for online and offline conduct.
Each linked document is published at ThaiSparks and may be updated from time to time. We will give you at least 30 days' notice of material changes to any of them (see section 16).
15. Indemnity
You agree to indemnify and hold harmless Demo Labs Pty Ltd, its affiliates, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms or any document incorporated by reference; (b) your content; (c) your interactions with other members; or (d) your violation of any law or third-party right.
16. Changes to these Terms
We may update these Terms from time to time. Material changes — changes affecting fees, data sharing, eligibility, termination rights, or the dispute-resolution process — will be announced at least 30 days in advance by email and in-app notice. Non-material clarifications and typo fixes may be made without notice.
Continuing to use ThaiSparks after a change takes effect means you accept the updated Terms. If you do not accept an updated version, you may delete your account.
17. Governing law and jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-laws rules. The courts of Victoria have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of ThaiSparks. Before commencing legal proceedings, we ask that you contact us at [email protected] to attempt to resolve the matter informally.
18. Service availability
We may limit, suspend, or refuse service in any region at our discretion. Where we withdraw the service from a region in which you are an existing member, we will give at least 30 days' notice by email unless we are legally required to act immediately. We are not obligated to make ThaiSparks available in every jurisdiction.
19. Entire agreement
These Terms, together with the documents incorporated by reference in section 14, constitute the entire agreement between you and Demo Labs Pty Ltd relating to ThaiSparks. They supersede any prior agreement or understanding.
